Refunds & Returns Policy

At Bitstream Media (David Fabri, ABN 30 217 394 498) we stand behind everything we make and do — our macOS software, GiftGambit, our web design and development work, and any physical products we supply. This policy explains your options if something isn’t right, and how those options work alongside your rights under Australian law.

Your rights under the Australian Consumer Law

Nothing in this policy limits or replaces your rights under the Australian Consumer Law (ACL). Those rights cannot be excluded.

For products (including our software and any physical goods):
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

For services (including web design and consulting):
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

The remedies set out below are offered in addition to these rights, not instead of them.

Software (SpectraMap, SpectraBridge and other one-time licences)

Our software is supplied as a digital download or licence. If the software is faulty, doesn’t do what we said it would, or otherwise fails to meet a consumer guarantee, contact us and we’ll make it right — by fixing the issue, reissuing a working licence, or providing a refund where the ACL requires one.

Because software is delivered digitally and can’t be “returned” once downloaded, we don’t offer change-of-mind refunds simply because you’ve decided you no longer want it. Where practical we offer trials or demos so you can confirm a tool suits your setup before purchasing. This does not affect your ACL rights if the software is faulty or not as described.

GiftGambit (Pro subscriptions and gift registries)

Your rights under the Australian Consumer Law come first here as everywhere else. If GiftGambit doesn’t
do what we said it does, isn’t fit for a purpose you told us about, or suffers a major failure, you can
cancel and get a refund for the unused part, and we’ll compensate you for any other reasonably foreseeable
loss. Nothing below reduces that.

Pro subscriptions

  • You can cancel at any time, yourself, in the app. See our
    Cancellation Policy.
  • Cancelling stops the next payment. Pro keeps working until the end of the period you have already paid for,
    and then the account drops back to Free.
  • We don’t automatically refund the remainder of a period you’ve already used, unless the ACL
    requires it — for example, where there has been a major failure of the service.
  • Dropping back to Free doesn’t delete anything. Your lists, circles, claims and history all stay; the
    free limits just apply again to adding new things.

Gift registries

A registry pass is a one-off purchase for one event. You build the registry and look at it for free, and you
only pay when you publish it — so you can see exactly what you’re buying before you buy it. Once
it’s published it has been delivered, and there is nothing to cancel afterwards.

If you didn’t mean to buy it

Digital subscriptions and registry passes can’t be handed back, so we don’t offer change-of-mind
refunds as a general rule. But some cases have an obvious right answer and we’d rather do it than keep the
money:

  • you were charged twice for the same thing;
  • you bought the wrong plan by mistake;
  • a renewal came around, you didn’t realise it was going to, and you haven’t used the new period;
    or
  • you paid for a registry and never published it.

we’ll refund it.

Free stays free

GiftGambit’s free tier is not a trial and does not expire, so there is never a charge to be surprised
by if you simply keep using it. We take no commission on anything bought or given through GiftGambit, so there is
nothing else you could be charged for.

Web design, development and consulting services

Custom work is, by its nature, built specifically for you, so we handle it as follows:

  • Before work begins, you can cancel and receive a refund of any amounts paid, less any costs we’ve already reasonably incurred.
  • Once work is underway, deposits and fees for work already performed are generally non-refundable, but we will always work with you to resolve concerns about the result.
  • If a service fails to meet a consumer guarantee under the ACL (for example, it isn’t carried out with due care and skill, or isn’t fit for a purpose you told us about), you’re entitled to the remedies described in the ACL section above — we’ll rectify a non-major problem within a reasonable time, and for a major failure you can cancel and receive a refund for the unused portion.

Other subscriptions and as-a-Service offerings

This covers subscriptions other than GiftGambit Pro, which is dealt with above. Where we supply a subscription or hosted service, the consumer guarantees apply for the period you’ve paid for. Cancelling a subscription stops future billing (see the Cancellation Policy) but doesn’t automatically refund a pre-paid period unless the ACL requires it — for example, where there’s been a major failure of the service.

Physical products

For physical products we offer, in addition to your ACL rights:

  • 30-day change of mind. If you change your mind within 30 days of receiving an item, email us at [email protected] with your order number for return instructions. The item must be unused and in “like new” condition with all original packaging and accessories. You’re responsible for return shipping, and we’ll refund the purchase price once we receive and inspect the item.
  • Faulty, damaged or incorrect items. If a product arrives damaged, is faulty, or isn’t what you ordered, we cover return shipping and will repair, replace or refund it in line with the ACL. For visible delivery damage, note it on signing where possible and email photos to [email protected] on the day of delivery, quoting your order number.

How to request a refund or return

Email [email protected] with your order number and a short description of the issue. We aim to respond within 2 business days. Approved refunds are issued to your original payment method. Prices on our site include GST, and refunds include the GST component.
